ADOPTED SENATE

A RESOLUTION


Urging that the Endangered Species Act of 1973 be amended and congressional House Resolution 3847 be passed; and for other purposes.

WHEREAS, Georgia's Congressional Delegation has introduced House Resolution 3847 into the United States House of Representatives; and

WHEREAS, this legislation would allow states suffering from droughts to be exempt temporarily from the Endangered Species Act, which in Georgia is threatening our low water supply by taking away large amounts of water from north Georgia and sending it downstream to protect mussels and sturgeon in Florida; and

WHEREAS, H. R. 3847 would amend the Endangered Species Act of 1973 to allow a state to be exempt from the Act when the Secretary of the Army or a governor declares that drought conditions are threatening the health, safety, and welfare of residents in a region served by a river basin managed by the federal government; and

WHEREAS, there is a critical shortage in Georgia's water resources, and the Army Corps of Engineers needs the latitude and the governors of each state need the authority to protect citizens; and

WHEREAS, when the health, safety, and welfare of the human population is threatened and all other means to find a solution have been exhausted, it is a logical conclusion that the provisions of the Endangered Species Act should be temporarily suspended.

NOW, THEREFORE, BE IT RESOLVED BY THE SENATE that this body does hereby urge the United States Congress to amend the 1973 Endangered Species Act and that congressional House Resolution 3847 be passed.

BE IT FURTHER RESOLVED that the Secretary of the Senate is authorized and directed to transmit an appropriate copy of this resolution to the Georgia Congressional Delegation.
