A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Code Section 12-5-31 of the Official Code of
1- 2 Georgia Annotated, relating to permits for the withdrawal,
1- 3 diversion, or impoundment of surface water, so as to
1- 4 prohibit granting of any application for a permit for any
1- 5 applicant who uses or proposes to use aquifer storage or
1- 6 recovery of surface water; to prohibit diversion,
1- 7 recharging, or placing water withdrawn pursuant to a permit
1- 8 into any aquifer; to provide for a definition; to provide
1- 9 for automatic repeal; to repeal conflicting laws; and for
1-10 other purposes.
1-11 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-12 SECTION 1.
1-13 Code Section 12-5-31 of the Official Code of Georgia
1-14 Annotated, relating to permits for the withdrawal,
1-15 diversion, or impoundment of surface water, is amended by
1-16 inserting at the end thereof the following:
1-17 "(p)(1) The director shall not grant any permit for
1-18 surface-water withdrawal, diversion, or impoundment for
1-19 any applicant who uses or proposes to use aquifer
1-20 storage or recovery of surface water. No water
1-21 withdrawn pursuant to a permit obtained under this Code
1-22 section shall be diverted, recharged, or otherwise
1-23 placed into any aquifer. For the purposes of this
1-24 subsection, the term 'aquifer' shall have the meaning
1-25 set out in Code Section 12-5-92. This subsection shall
1-26 be automatically repealed December 31, 2004.
1-27 (2) The provisions of this subsection shall apply only
1-28 for permits requested in a coastal area, as such term is
1-29 defined in paragraph (4) of Code Section 12-5-322."
1-30 SECTION 2.
1-31 All laws and parts of laws in conflict with this Act are
1-32 repealed.
