A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Title 43 of the Official Code of Georgia Annotated,
1- 2 relating to professions and businesses, so as to change the
1- 3 definition of "utility systems" for which a license or
1- 4 certificate issued by the State Construction Industry
1- 5 Licensing Board is required for certain work thereon; to
1- 6 provide that registered professional engineers who
1- 7 demonstrate competency in soils classification and the
1- 8 suitability of sites for on-site sewage management systems
1- 9 may perform certain investigations and evaluations; to
1-10 repeal conflicting laws; and for other purposes.
1-11 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-12 SECTION 1.
1-13 Title 43 of the Official Code of Georgia Annotated, relating
1-14 to professions and businesses, is amended in Code Section
1-15 43-14-2, relating to definitions regarding the State
1-16 Construction Industry Licensing Board, by striking in its
1-17 entirety paragraph (17) and inserting in lieu thereof a new
1-18 paragraph (17) to read as follows:
1-19 "(17) 'Utility system' means any system at least five
1-20 feet underground, when installed or accessed by
1-21 trenching, open cut, cut and cover, or other similar
1-22 construction methods which install or access the system
1-23 from the ground surface, including, but not limited to,
1-24 gas distribution systems, electrical distribution
1-25 systems, communication systems, water supply systems,
1-26 sanitary sewerage and drainage systems, reservoirs and
1-27 filtration plants, water and waste-water treatment
1-28 plants, leachate collection and treatment systems
1-29 associated with landfills, and pump stations, when the
1-30 system distributes or collects a service, product, or
1-31 commodity for which a fee or price is paid for said
1-32 service, product, or commodity or for the disposal of
1-33 said service, product, or commodity."

2- 1 SECTION 2.
2- 2 Said title is further amended in Code Section 43-15-18,
2- 3 relating to the effect of a certificate of registration as
2- 4 professional engineer or land surveyor, by adding at the end
2- 5 thereof a new subsection (c) to read as follows:
2- 6 "(c) A professional engineer may perform investigations
2- 7 and evaluations of the suitability of a site for an
2- 8 on-site sewage management system, provided that the
2- 9 professional engineer demonstrates competency by the
2-10 successful completion of at least six quarter hours, or
2-11 the semester equivalent, of college level courses or eight
2-12 hours of continuing education, which courses or continuing
2-13 education relate specifically to soils classification and
2-14 the suitability of sites for on-site sewage management
2-15 systems. As used in this subsection, the term 'on-site
2-16 sewage management system' shall have the same meaning as
2-17 provided in paragraph (3) of subsection (a) of Code
2-18 Section 31-2-7."
2-19 SECTION 3.
2-20 All laws and parts of laws in conflict with this Act are
2-21 repealed.
