A BILL TO BE ENTITLED
AN ACT
1- 1 To provide for an advisory referendum election to be held in
1- 2 the Town of Tyrone for the purpose of ascertaining the type
1- 3 of government for said town desired by the people of said
1- 4 town; to provide for procedures, requirements, and other
1- 5 matters relative thereto; to repeal conflicting laws; and
1- 6 for other purposes.
1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1- 8 SECTION 1.
1- 9 It is the purpose of this Act to provide for an advisory
1-10 referendum election within the Town of Tyrone to determine
1-11 the type of government of the Town of Tyrone preferred by
1-12 the voters of said town.
1-13 SECTION 2.
1-14 (a) It shall be the duty of the election superintendent of
1-15 the Town of Tyrone to issue the call for an advisory
1-16 referendum election for the purpose of submitting a question
1-17 to the electors of said town to determine the type of
1-18 government preferred by a majority of the electors voting at
1-19 said election. The superintendent shall set the date of such
1-20 election for the same date as the date of the general
1-21 municipal election held in the Town of Tyrone in 1998. The
1-22 superintendent shall issue the call for such election at
1-23 least 30 days prior to the date thereof. The superintendent
1-24 shall cause the date and purpose of the election to be
1-25 published once a week for two weeks immediately preceding
1-26 the date thereof in the official organ of Fayette County.
1-27 The ballot shall have printed thereon the following:
1-28 "Advisory Referendum Election
1-29 Select the form of government for the Town of Tyrone which
1-30 you favor by placing a check mark (/) or (x) in the
1-31 appropriate space below. Choose one only:
1-32 _________ Retain the current mayor and council form of
1-33 government.

2- 1 _________ Establish a council form of government with
2- 2 a hired town manager."
2- 3 (b) It shall be the duty of the election superintendent of
2- 4 the Town of Tyrone to hold and conduct the advisory
2- 5 referendum election provided for in this section and to
2- 6 tabulate the results of such election. It shall be the
2- 7 further duty of said superintendent to certify the results
2- 8 of said election to the Secretary of State and to each
2- 9 member of the General Assembly whose senatorial or
2-10 representative district lies wholly or partially within the
2-11 Town of Tyrone. The expense of such election shall be borne
2-12 by the Town of Tyrone.
2-13 (c) It is found, determined, and declared that the holding
2-14 of the advisory referendum election provided for in this
2-15 section is in all respects for the benefit of the people of
2-16 the Town of Tyrone and is for a public purpose and is an
2-17 essential governmental function for which public funds may
2-18 be expended.
2-19 SECTION 3.
2-20 All laws and parts of laws in conflict with this Act are
2-21 repealed.
