                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Chapter 13 of Title 16 of the Official Code of 
  1- 2  Georgia Annotated, relating to controlled substances, so as 
  1- 3  to change the listing of controlled substances and dangerous 
  1- 4  drugs; to delete certain penalty provisions relating to 
  1- 5  carisoprodol; to provide an effective date; to repeal 
  1- 6  conflicting laws; and for other purposes. 
 
  1- 7       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 8                           SECTION 1. 
 
  1- 9  Chapter 13 of Title 16 of the Official Code of Georgia 
  1-10  Annotated, relating to controlled substances, is amended by 
  1-11  striking the period and inserting a semicolon at the end of 
  1-12  subparagraph (AA) of paragraph (6) of Code Section 16-13-27, 
  1-13  relating to Schedule III controlled substances, and 
  1-14  inserting immediately thereafter the following: 
 
  1-15      "(7) Ketamine." 
 
  1-16                           SECTION 2. 
 
  1-17  Said chapter is further amended by adding in the appropriate 
  1-18  position in subsection (a) of Code Section 16-13-28, 
  1-19  relating to Schedule IV controlled substances, the 
  1-20  following: 
 
  1-21      "(30.15) Sibutramine;".

  1-23  Said chapter is further amended by striking from subsection 
  1-24  (b) of Code Section 16-13-71, listing the dangerous drugs, 
  1-25  the following paragraphs:

  4- 8  (c) of Code Section 16-13-71, listing the dangerous drugs, 
  4- 9  the following: 
 
  4-10      "(14.2) Minoxidil--when used with a strength up to 2 
  4-11      percent in a topical skin product; 
 
  4-12      (23) Pseudoephedrine--where the dosage unit is not more 
  4-13      than 60 mg. or, when manufactured to release the drug in 
  4-14      delayed action slow time release, where the dosage unit 
  4-15      is not more than 120 mg.; 
 
  4-16      (27.5) Tioconazole--when used with a strength up to 1 
  4-17      percent in a topical product;". 
 
  4-18                           SECTION 6. 
 
  4-19  Said chapter is further amended by adding in the appropriate 
  4-20  positions in subsection (c) of Code Section 16-13-71, 
  4-21  listing the dangerous drugs, the following: 
 
  4-22      (3.5) Bentoquatam--when used with a strength of 5 
  4-23      percent or less in topical preparations; 
 
  4-24      (7.9) Dexbrompheniramine--when a single dosage unit is 6 
  4-25      mg. or less; 
 
  4-26      (12.3) Ketoconazole--when used with a strength of 1 
  4-27      percent or less in topical preparations; 
 
  4-28      (14.2) Minoxidil--when used with a strength of 5 percent 
  4-29      or less in topical preparations; 
 
  4-30      (23) Pseudoephedrine--when a single dosage unit is 60 
  4-31      mg. or less or when manufactured in an extended release 
  4-32      form with a dosage unit of 240 mg. or less; 
 
  4-33      (27.5) Tioconazole--when used with a strength of 1 
  4-34      percent or less in topical preparations or when used 
  4-35      with a strength of 6.5 percent or less in vaginal 
  4-36      preparations;

  5- 1      (29.5) Zinc acetate--when used in topical 
  5- 2      preparations;". 
 
  5- 3                           SECTION 7. 
 
  5- 4  Said chapter is further amended by striking subsection (d) 
  5- 5  of Code Section 16-13-79, relating to penalties, which reads 
  5- 6  as follows: 
 
  5- 7    "(d) Any person who obtains carisoprodol by fraud, theft, 
  5- 8    deceit, misrepresentation, subterfuge, forgery or 
  5- 9    alteration of a prescription or written order, concealment 
  5-10    of a material fact, or the use of a false name shall be 
  5-11    guilty of a felony and punished by imprisonment for not 
  5-12    less than one year nor more than three years or by a fine 
  5-13    not to exceed $5,000.00 or both." 
 
  5-14                           SECTION 8. 
 
  5-15  This Act shall become effective upon its approval by the 
  5-16  Governor or upon its becoming law without such approval. 
 
  5-17                           SECTION 9. 
 
  5-18  All laws and parts of laws in conflict with this Act are
