HB 937 LC 9 7950 A BILL TO BE ENTITLED AN ACT 1- 1 To amend an Act providing a new charter for the City of 1- 2 Blackshear, approved March 19, 1993 (Ga. L. 1993, p. 4091), 1- 3 as amended, so as to change the corporate limits of the 1- 4 city; to repeal conflicting laws; and for other purposes. 1- 5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 6 An Act providing a new charter for the City of Blackshear, 1- 7 approved March 19, 1993 (Ga. L. 1993, p. 4091), as amended, 1- 8 is amended by striking Section 1.11 of said Act and 1- 9 inserting in lieu thereof a new Section 1.11 to read as 1-10 follows: 1-11 "SECTION 1.11. 1-12 Corporate boundaries. 1-13 (a) The boundaries of this city shall be those existing on 1-14 the effective date of the adoption of this charter with 1-15 such alterations as may be made from time to time by local 1-16 law or in the manner provided by general law. The 1-17 boundaries of this city at all times shall be shown on a 1-18 map, a written description, or any combination thereof, to 1-19 be retained permanently in the office of the city clerk of 1-20 the city and to be designated, as the case may be: 1-21 'Official Map or Description of the Corporate Limits of 1-22 the City of Blackshear, Georgia.' Photographic, typed, or 1-23 other copies of such map or description certified by the 1-24 mayor shall be admitted as evidence in all courts and 1-25 shall have the same force and effect as the original map 1-26 or description. 1-27 (b) In addition to such boundaries as described in 1-28 subsection (a) of this section, the boundaries of the city 1-29 shall also include the following described territory, to 1-30 wit: -1- (Index) LC 9 7950 2- 1 TRACT ONE: 2- 2 All that tract or parcel of land situate, lying and 2- 3 being 53.214 acres of land in Land Lot 94 of the 4th 2- 4 Land District of Pierce County, Georgia, being more 2- 5 particularly shown on that plat of survey prepared by D. 2- 6 Lavone Herrin, G.R.L.S. NO. 2171, dated October 25, 2- 7 1993, and recorded in the office of the Clerk of the 2- 8 Pierce County Superior Court in Plat Book 14, page 110, 2- 9 reference being made to said plat for all proper 2-10 purposes. Said tract being a portion of that tract 2-11 containing 166.5 acres, more or less, described in that 2-12 certain deed to assent dated October 29, 1984, and 2-13 recorded in deed Book 192, page 561, in the public land 2-14 records of Pierce County, Georgia. 2-15 TRACT TWO: 2-16 That certain lot, tract or parcel of land consisting of 2-17 69.905 acres, more or less, of original Land Lot No. 95 2-18 of the 4th Land District of Pierce County, Georgia, 2-19 being more particularly described as follows: From the 2-20 Southeast corner of Land Lot No. 95 of the 4th Land 2-21 District of Pierce County, Georgia, thence running North 2-22 24 degrees 17 minutes 55 seconds West for a distance of 2-23 2,060.52 feet to a concrete marker, the last mentioned 2-24 concrete marker being the point or place of beginning; 2-25 thence running along the center of a certain branch in a 2-26 Southwesterly direction to a concrete marker on the 2-27 Eastern margin of that certain public road known as the 2-28 County Farm Road, being a paved road and being State 2-29 Road 1903; thence running along the eastern margin of 2-30 said State Road 1903 in Northeasterly direction for a 2-31 distance of 673.73 feet to a right-of-way marker; thence 2-32 running along the Eastern margin of said State Road No. 2-33 1903 North 08 degrees 36 minutes East for a distance of 2-34 1,252.86 feet West to a concrete marker; thence running 2-35 South 85 degrees 40 minutes 15 seconds East for a 2-36 distance of 1,603.53 feet to a concrete marker, thence 2-37 running South 08 degrees 36 minutes West for a distance 2-38 of 1602.02 feet to the point or place of beginning, and 2-39 being bounded as follows: on the North and East by 2-40 other lands of Pierce County, Georgia, commonly known as 2-41 the Pierce County Farm property; on the West by that 2-42 certain public road known as the County Farm Road and 2-43 designated as State Road 1903 and on the South by the 2-44 run of a certain branch separating the within lands from -2- (Index) LC 9 7950 3- 1 lands of C. T. Houston and lands of W. L. Houston. For 3- 2 a more complete description of the within described real 3- 3 property reference is hereby made to a plat made from a 3- 4 survey by Addison L. Strickland, Pierce County Surveyor 3- 5 on July 22, 1977, a copy of said plat to be recorded 3- 6 along with this instrument. Reference is hereby made to 3- 7 said plat for all purposes. 3- 8 TRACT THREE: 3- 9 All that tract and parcel of land situate, lying and 3-10 being in Land Lot 47 of the 4th Land Disrict of Pierce 3-11 County, Georgia, containing 47.245 acres and more 3-12 particularly described as follows: Beginning at a point 3-13 on the northern right of way of that certain paved 3-14 street in Pierce County, Georgia known as Moore Street 3-15 where it intersects a certain graded road known as Grady 3-16 Street Extension and from said point thence North 2 3-17 degrees 17 minutes East a distance of 478.63 feet to a 3-18 point; thence North 2 degrees 15 minutes 20 seconds a 3-19 distance of 753.19 feet to a point; thence North 1 3-20 degree 37 minutes 24 seconds East a distance of 473.29 3-21 feet to a point; thence 0 degrees 24 minutes 45 seconds 3-22 East a distance of 44.37 feet to a point; thence South 3-23 87 degrees 36 minutes 40 seconds East a distance of 3-24 1246.91 feet to a point; thence South 6 degrees 01 3-25 minutes 49 seconds a distance of 636.78 feet to a point; 3-26 thence South 4 degrees 26 minutes 42 seconds West a 3-27 distance of 912.01 feet to a point; thence North 85 3-28 degrees 16 minutes 04 seconds West a distance of 148.32 3-29 feet to a point; thence South 3 degrees 42 minutes 24 3-30 seconds West a distance of 213.82 feet to a point; 3-31 thence North 87 degrees 19 minutes 01 seconds West a 3-32 distance of 1009.69 feet to a point this point being the 3-33 point of place of beginning of the tract herein 3-34 conveyed. Reference is hereby made to that certain plat 3-35 of survey prepared by D. Lavone Herrin, Georgia 3-36 Registered Land Surveyor Number 2171, dated October 15, 3-37 1993, recorded in Plat Book 14, page 58 of the Pierce 3-38 County Land Records. Said plat is referred to for all 3-39 legal and descriptive purposes. 3-40 TRACT FOUR: 3-41 All that tract or parcel of land situate, lying and 3-42 being in original Land Lots 3, 4 and 44 of the 9th Land 3-43 District of Pierce County, Georgia consisting of 175.10 3-44 acres, more or less, all as shown by that certain plat -3- (Index) LC 9 7950 4- 1 of survey, dated January 7, 1992, by H. W. Prevatt, 4- 2 G.R.L.S., which plat is recorded in Plat book 13, page 4- 3 148 in the office of the Clerk of the Superior Court of 4- 4 Pierce County, Georgia. 4- 5 TRACT FIVE: 4- 6 All that tract or parcel of land situate, lying and 4- 7 being in Pierce County, Georgia; consisting of all of U. 4- 8 S. Highway 84 and its right of ways extending from the 4- 9 Western city limits of the City of Blackshear, Georgia, 4-10 to the Eastern City limits of the City of Waycross, 4-11 Georgia. 4-12 TRACT SIX: 4-13 All that tract or parcel of land sitaute lying and being 4-14 in Pierce County, Georgia consisting of all of U.S. Hwy 4-15 84 and its right of ways extending from the Eastern city 4-16 limits to the intersection of U.S. Hwy. 84 and County 4-17 Farm Road (State Road 307), which is a distance of one 4-18 (1) mile. 4-19 TRACT SEVEN: 4-20 All that tract or parcel of land situate, lying and 4-21 being in Pierce County, Georgia, consisting of all 4-22 County Farm Road, (State Road 307) and its right of 4-23 ways, extending from the intersection of County Farm 4-24 Road (State Road 307) and U. S. Highway 84 for a 4-25 distance of two (2) miles to the intersection of County 4-26 Farm Road (State Road 307) and Money Hole Road (County 4-27 Road 382). 4-28 TRACT EIGHT: 4-29 All that tract or parcel of land situate, lying and 4-30 being in Pierce County, Georgia, beginning at the 4-31 intersection of Gordon Street with the city limits of 4-32 the City of Blackshear, Georgia, and proceeding a 4-33 distance of 178 feet to the intersection of Gordon 4-34 Street with Moore Street and from the intersection from 4-35 Gordon Street and Moore Street for a distance of 0.2 4-36 miles to the intersection of Grady Street and Moore 4-37 Street, including all rights of ways associated with the 4-38 said Gordon Street and Moore Street." SECTION 2. 4-39 All laws and parts of laws in conflict with this Act are 4-40 repealed. -4- (Index)
