HB 1637 LC 18 7483S A BILL TO BE ENTITLED AN ACT 1- 1 To amend Code Section 16-12-22.1 of the Official Code of 1- 2 Georgia Annotated, relating to raffles operated by 1- 3 nonprofit, tax-exempt organizations, so as to change certain 1- 4 provisions regarding annual fees; to change certain 1- 5 provisions regarding special limited licenses to conduct 1- 6 raffles; to repeal conflicting laws; and for other purposes. 1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 8 Code Section 16-12-22.1 of the Official Code of Georgia 1- 9 Annotated, relating to raffles operated by nonprofit, 1-10 tax-exempt organizations, is amended by striking paragraph 1-11 (1) of subsection (d) and inserting in its place a new 1-12 paragraph (1) to read as follows: 1-13 "(d)(1) Any nonprofit, tax-exempt organization desiring 1-14 to obtain a license to operate raffles shall make 1-15 application to the sheriff on forms prescribed by the 1-16 sheriff. and shall pay The sheriff may require the 1-17 payment of an annual fee of not to exceed $100.00. No 1-18 license shall be issued to any nonprofit, tax-exempt 1-19 organization unless the organization has been in 1-20 existence for 24 months immediately prior to the 1-21 issuance of the license. The license will expire at 1-22 12:00 Midnight on December 31 following the granting of 1-23 the license. Renewal applications for each calendar 1-24 year shall be filed with the sheriff prior to January 1 1-25 of each year and shall be on a form prescribed by the 1-26 sheriff." SECTION 2. 1-27 Said Code section is further amended by striking subsection 1-28 (g) and inserting in its place a new subsection (g) to read 1-29 as follows: 1-30 "(g) Notwithstanding the other provisions of this Code 1-31 section, the sheriff, upon receiving written evidence of -1- (Index) LC 18 7483S 2- 1 the bona fide nonprofit, tax-exempt status of the 2- 2 applicant organization, application therefor, shall be 2- 3 authorized to issue a special limited license to a 2- 4 nonprofit, tax-exempt organization which will allow it to 2- 5 operate up to three raffles during a calendar year. Each 2- 6 such single raffle shall be conducted in its entirety 2- 7 during a period not to exceed 30 days. In such cases, the 2- 8 sheriff shall waive the application and license fee 2- 9 provided for in subsection (d) of this Code section and 2-10 the annual report provided for in subsection (j) of this 2-11 Code section." SECTION 3. 2-12 All laws and parts of laws in conflict with this Act are 2-13 repealed. -2- (Index)
